Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the www.containermobileoffice.com website and (the “Service”) operated by Container Mobile Office Construction Ltd registered address PMB: TN1812 Accra Ghana. Company number CS522712014 (“us”, “we”, or “our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Containermobileoffice.com does not give any warranty or other assurance as to the operation, quality or functionality of the site. Access to the site may be interrupted, restricted or delayed for any reason.

To the full extent permissible by law, Containermobileoffice.com disclaims all responsibility for any damages or losses (including, without limitation, financial loss, damages for loss in business projects, loss of profits or other consequential losses) arising in contract, tort or otherwise from the use of or inability to use the site or any material appearing on  or from any action or decision taken as a result of using Containermobileoffice.com or any such material.

General warranty & Guarantee

CMOC Ltd do hereby warrant that all material furnished and work performed in conjunction with any referenced project are in compliance with the Contract Documents and authorized modifications thereto, and will be free from defects due to defective materials or workmanship for a period of (1) year or a time as specified in the Project Manual from the Date of Handover.

Should any defects develop during the warranty period due to improper material, workmanship, or arrangement, the same, including adjacent work displaced, shall be made good by the undersigned at no expense to the Owner.

The Owner will give contractor written notice of defective work. Should the contractor fail to correct defective work within Thirty (30) days after receipt of written notice, Owner may, at his or her option, correct and charge contractor cost for such correction. Contractor agrees to pay such charges upon demand. Nothing in the above shall be deemed to apply if care is not taken to maintain proper use of materials/equipment etc. or if abused or neglected by the Owner.

Delay penalty & Determination of Contract

If CMOC Ltd fails to maintain the required rate of progress or to complete the work and clear the site on or before the contract timeline or extended date of completion, we shall without prejudice to any other right or remedy available under the law, pay compensation the amount calculated at the rates stipulated below or such smaller amount as both parties may decide (whose decision in writing shall be final and binding) on the amount of the tendered value of the work for every completed day / week (as applicable ) that the progress remains below or that the work remains incomplete. Completion period not exceeding 5 weeks (stipulated) @ 0.5% per week or part thereof provided always that the total amount of compensation for delay to be paid under this condition shall not exceed 1% of the tendered value of work.

CMOC Ltd shall be responsible for all it’s own staff members during the duration of the entire project within the designated site.

Cancellation and Refund Policy

By availing our service, you authorize Containermobileoffice.com to start the work immediately, however, you have the right to cancel your contract at any time before any down payment is made. In order to cancel the contract, you must inform a member of the support team by emailing support@containermobileoffice.com requesting cancellation. Cancelling your contract after a payment has been taken does not automatically qualify for a refund. Our processing team work in real time and will in many cases will have started the review of your work details and the tailoring of your Bespoke Converted Container Office Units report within hours of you signing up for the service, and this may affect your right to receive a refund.

Administration Fees or deposits

If you request cancellation of the service and a refund is being considered after the service has begun, an administration fee or deposits may be retained.

None Refundable deposits

A down payment is a type of payment made in cash during the onset of the purchase of a property or expensive service. The payment typically represents only a percentage of the full purchase price; in some cases, it’s not refundable if the deal falls through I.e.,

  • Deposits made on agreed project are none refundable after six (6) months of signed contract if the purchaser changes mind due to own negligence.
  • Quotations are valid for 15 – 30 days and subject to change.
  • Down payment are limited to 80% deposit upon signing of agreement & 20% final settlement at the end of the contract timeline upon inspection and acceptance of work. (payment terms are subject to change & negotiable)

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Data Protection – Privacy Policy

Personal Information will be protected by security safeguards that are appropriate to the sensitivity level of the information.

All employees and independent contractors are expected to maintain the confidentiality of customer information at all times and failing to do so will result in appropriate disciplinary measures, which may include dismissal.
